I, in the rest of the document referred to as "I" and "Undersigned", do hereby give Lovings, Inc the irrevocable right to use the given photographs/voice recordings/video/digital media, and submitted information/text/phone numbers and other contact information (hereafter "Content") for reproduction in any medium designated on the order form or receipt or invoice for purposes of advertising/promotion as designated on the same form.
I further release Lovings, Inc from any claims of remuneration associated with any form of damage, foreseen or unforeseen, associated with the proper commercial or artistic use of this Content as specified on the order form or receipt or invoice.
I fully understand that Lovings, Inc does not screen the viewers of its Internet Web site, takes no responsibility for their conduct, and cannot be held accountable for any Internet, server and/or other outages and technical difficulties or adult content blocking that may limit the access to my advertisement. Lovings, Inc will, however, upon request, offer a credit for the actual Web Site off-line time if longer than 24 hours, of the value equal to the actual advertising cost during the off-line time only.
I certify that I am over 18 years old or of the legal age in my area, should this be higher. I certify that I am pictured in and have the right of use of the Content given to Lovings, Inc for the purpose specified in the order form or receipt or invoice and that I am in full legal possession of the Content. I further certify that all Content is produced in accordance with all applicable provisions of the Child Protection Restoration and Penalties Enhancement Act and are fully compliant with all requirements of 18 U.S.C.§ 2257 and all other applicable Federal, State and Local laws and regulations.
If my ad is placed or managed by a person other than myself, I certify that they have my full permission to do so, and to provide any Content and/or billing/contact information and/or payment related to my advertising. If I no longer wish to be represented by this person, I will notify Lovings, Inc in writing or through personal email of my wish within 3 days, upon which time I will take all the responsibilities for Content, any due bills and future payments for my ad, or delegate another representative, also in writing. I will not hold Lovings, Inc responsible for my failure to do so.
The Undersigned certifies that I and all the individuals pictured or discussed in Content submitted fully understand that the submitted Content is to be used in relation to adult entertainment advertisement/promotion including publishing of the Content on Internet World Wide Web as specified on the order form or receipt or invoice.
The Undersigned certifies that the advertising purchased is not to be used for promotion of any illegal activities.
The Undersigned certifies that the identification (IDs) provided with this Model release are true legal documents belonging to the Undersigned, and takes full legal and criminal responsibility for that statement. The Undersigned understands that in case that the fraudulent documents were provided, Lovings, Inc upon discovery reserves the right to immediately remove any advertisements and take other steps, including but not limited to such as notifying proper authorities and a permanent ban of the Undersigned and/or any agents from advertising on Lovings, Inc Web Sites, and that no credit nor refund will be issued.
Any disputes will be handled by mediation and /or arbitration through the neutral parties mutually agreed upon, under jurisdiction of the state of California. If either party disputes the decisions of the mediators/arbitrators within 30 days, any further disputes will be continued in California, under jurisdiction and laws of the state of California. Should any of the clauses of this contract be unenforceable in the state/county/city of residence of either party, the rest of the clauses are still legally binding and in effect.
The Undersigned certifies that I have read the foregoing and fully understand the meaning and effect thereof, and have entered this agreement of my own free will, and not under influence of any substances or duress or pretenses of purpose other than stated in this agreement. |
